وقف ٹریبیونل کو غیر مؤثر بنایا گیا — مولانا سید جمیل کی وارننگ: مسلم امت کی شرعی جائیدادیں خطرے میں

وقف ایکٹ میں ہونے والی حالیہ ترامیم پر معروف وقف امور کے ماہر مولانا سید جمیل نے گہری تشویش کا اظہار کیا ہے۔ ان کے مطابق یہ صرف قانونی ترمیم نہیں بلکہ امتِ مسلمہ کی دینی وراثت اور انصاف کے نظام پر سنگین حملہ ہے۔
وقف ٹریبیونل کو بنایا گیا بےجان:
مولانا نے وضاحت کی کہ ترمیم شدہ ایکٹ کی دفعہ 2 اور 3(C) کے تحت وقف سے متعلق ٹرسٹ معاملات کو اب وقف ٹریبیونل کے دائرہ اختیار سے خارج کر دیا گیا ہے، جو کہ وقف تنازعات کے لیے مخصوص پلیٹ فارم تھا۔ اب اسے تقریباً غیر فعال بنا دیا گیا ہے۔
“جب وقف ٹریبیونل جیسا ادارہ کمزور ہو جائے تو عام مسلمان کو انصاف کہاں سے ملے گا؟ یہ انصاف کے حق پر حملہ ہے۔”
سپریم کورٹ کے واپس کیے گئے 187 مقدمات:
مولانا جمیل کے مطابق، سپریم کورٹ نے 187 متنازعہ وقف مقدمات کو دوبارہ غور کے لیے وقف بورڈ کو واپس بھیجا تھا، لیکن بورڈ نے ان میں سے اکثر املاک کو “غیر وقف” قرار دے دیا۔
ان کا الزام ہے کہ یہ ترمیم خاص طور پر ممبئی کی اربوں کی وقف جائیدادوں کو قانونی تحفظ دینے کے بہانے لائی گئی ہے، حالانکہ وہ حقیقی معنوں میں وقف نہیں ہیں۔
امت مسلمہ سے جذباتی اپیل:
مولانا نے امت سے اپیل کرتے ہوئے کہا کہ اب وقت ہے کہ ہم بیدار ہوں، منظم ہوں اور اپنی شرعی امانتوں کی حفاظت کریں۔

“یہ معاملہ صرف زمین کا نہیں، بلکہ ہماری دینی شناخت، شریعت کی علامتوں اور آنے والی نسلوں کی امانت کی حفاظت کا ہے۔ اگر ہم آج خاموش رہے تو کل کی نسلیں ہمیں معاف نہیں کریں گی۔”
